JLG Welcomes New Healthcare Attorney

Jolley Law Group is pleased to announce that Ariail Kirk has joined the firm in its Columbia, SC office. Ariail Kirk is a healthcare litigator and experienced administrative lawyer. Ariail co-leads the firm’s healthcare practice and has significant experience in the South Carolina Administrative Law Court and before state and federal regulatory agencies.  In her practice, she handles healthcare matters related to certificate of need and applicability determinations, Medicare and Medicaid provider appeals, as well as civil litigation matters for healthcare clients.  Ariail’s regulatory background allows her to assist professionals and corporations in matters before the Board of Medical Examiners, the Board of Pharmacy, and other Boards under the purview of the South Carolina Department of Labor, Licensing, and Regulation and to advise and assist hospitals and other healthcare providers in their efforts to obtain regulatory approvals for new healthcare facilities and services. Ariail practiced in Columbia and served as counsel at the South Carolina Public Employee Benefit Authority prior to joining JLG.  She utilizes her knowledge in advising businesses and health care providers on a variety of regulatory and operational matters, including employee benefit plans and the Affordable Care Act. News Brief: Final MACRA Rule Issued

On October 14, the Centers for Medicare and Medicaid Services (CMS) issued its final rule for the Medicare Access and CHIP Reauthorization Act of 2015 (MACRA). MACRA replaces Medicare’s current payment system for physicians, which pays doctors based on volume, with a Quality Payment Program (QPP) that will pay doctors based on value – in other words, patient outcomes. The QPP applies to physicians, physician assistants, nurse practitioners, clinical nurse specialists, and certified registered nurse anesthetists who provide care for more than 100 Medicare patients a year and bill Medicare more than $30,000 a year.
