Employer Responsibilities Under the Accountable Care Act

Beginning in 2015, employers with a minimum number of employees (generally 50 full-time employees or a combination of full-time and part-time employees that is equivalent to 50 full-time employees) will be subject to the Employer Shared Responsibility provisions (under section 4980H of the Internal Revenue Code) created by the Affordable Care Act (the ACA). Under the Employer Shared Responsibility provisions, if a large employer does not offer affordable health coverage that provides a minimum level of coverage to its full-time employees (and their dependents), the employer may be subject to an Employer Shared Responsibility penalty payment. The regulations regarding this Employer Mandate are complex, and avoiding or minimizing penalties requires careful advance planning.

Employers that do not meets the 50 full-time employee threshold also have new reporting and notice requirements under the ACA.
